Payment Terms
All invoices must be paid within 30 days of the invoice date. Any unpaid invoices after this period will incur a 1% excess interest per month, compounded on the outstanding balance with no exceptions.
Claims Settlement
To ensure prompt and full settlement of claims:
- The total value of the shipment must be declared at the time of shipping.
- All delivery receipts must be signed at the time of delivery, with any damage noted and described.
- Concealed damage claims must be reported immediately upon discovery. The claim amount will reduce daily and reach 0% if the concealed damage is reported more than five days after delivery.
Service Terms
- No discounts or credits will be provided for late shipments, late pickups, or late deliveries.
- All shipments, whether prepaid or collect, will be handled according to TLI Express’s standard procedures. Accessorial rates and/or charges apply as follows:
- Prepaid Freight: Accessorial charges paid by the consignor.
- Collect Freight: Accessorial charges paid by the consignee.
- Connecting Line Freight: Accessorial charges paid by the consignee.
- If preauthorization of accessorial services is required, the consignor must provide the contact details of the authorized person on the Bill of Lading. Failure to provide this information will nullify the preauthorization requirement.
Credit Terms
Collect shipments to customers or third-party payers without established credit will be rated at the shipper’s pricing, based on 130% of the applicable rates or minimum charge. This does not apply if no pricing provisions are applicable.
5. Rate Revisions
All rates and quotations are subject to periodic revisions, increases, and restructuring. While TLI Express will strive to inform users of changes, it is the user’s responsibility to verify the current status of all rates, quotations, and information.
6. Bill of Lading
The terms and conditions of the Standard Truckload Bill of Lading shall apply. TLI Express drivers are not authorized to bind the company to non-conforming bills of lading. Any conflicting terms on a customer’s bill of lading will be subordinate to TLI Express’s tariff terms.
7. Brokerage Services
TLI Express reserves the right to act as a broker rather than a motor carrier. In such cases, TLI Express’s liability and obligations will be as a broker, not a carrier.
8. Waivers
TLI Express’s failure to enforce any term of this tariff does not constitute a waiver of its rights. No waiver will be valid unless in writing and signed by authorized TLI Express personnel.
9. Service Guarantees
TLI Express does not offer guaranteed service on any shipments. Deliveries will be made upon reasonable dispatch. Appointment times and delivery notations such as “must deliver by” do not alter this standard.
10. Refusal Rights
TLI Express reserves the right to refuse any shipment for any reason, including the unavailability of equipment.
11. Force Majeure
TLI Express’s non-performance due to force majeure conditions, including but not limited to natural disasters, war, terrorism, and labor disturbances, is excused.
12. Restricted Commodities
TLI Express will not transport explosives, garbage, hazardous waste, household goods, furniture, people, pets, or contraband artwork. All shipments must comply with safety regulations.
13. Loading and Unloading
Shipments must be loaded by the consignor and unloaded by the consignee. TLI Express drivers are not responsible for loading or unloading shipments. Assistance by drivers does not imply TLI Express liability for shortages or damage.
14. Inspection Rights
Customers have the right to inspect trailers. TLI Express may replace the trailer or reject the load tender based on inspection results.
15. Applicable Law
This tariff applies to all shipments handled by TLI Express, regardless of origin or destination. The terms are subject to change without notice, and the version in effect at the time of shipment acceptance will apply.
By contracting with TLI Express, the Customer agrees to these terms and conditions.
